Trump Lawsuit Seeking Gambling
Revenue From Pequot TribeIn a lawsuit
that was started back in 2003, Donald Trump (along
with Amalgamated Industries) are still trying to
bring cases against the Eastern Pequot Indian tribe
for backing out on a deal with Trump, and picking up
Eastern Capital Development instead.
What is making the case tricky is that the tribe
is currently not federally recognized by the
government. However, Trump and Amalgamated are
pushing the case to court anyways, hoping the tribe
will be recognized in full light of the events.
The case is currently in Appellate Court, which
was ruled by a Judge on May 2 to go forward into
higher court. However, the lawsuit is in
limbo, awaiting an appeal motion by the Pequot
Indians, who are entitled to one, due to their
sovereign immunity.
Even if the tribe is not federally recognized,
the case could still go to court on the grounds that
Trump had a deal with the Pequot's that would
entitle him to future earnings of the tribes casino
revenue.
Attorney's for both sides are chiseling away at
this case, each hoping the court will rule in their
favor. Robert Tobin, an attorney for the
Pequot's, is pushing to not even have the case move
forward since the tribe has sovereign immunity.
Attorney's for Trump and Amalgamated are pushing to
have the tribe recognized by the government - but
that even if they are not, for the case to be
allowed to continue on.
The deciding factor of the case will be just how
the federal government views sovereign immunity, and
what that entails in regards to lawsuits and the
court system.
