In a situation that sounds similar to the ongoing
confrontation between the U.S. and Antigua, UK online gambling companies are
serious about possibly filing suit against internet gaming regulators in Italy. As reported by the UK Register, several British members of the Remote Gaming Alliance (RGA) have
already begun an outcry against the Italian governments decision to adopt new
regulations that would restrict Italian citizens from logging onto online casino
and gambling sites being operated outside of Italy.
The law essentially
states that any Internet Service Provider based in Italy who is caught
permitting access to foreign online casinos will be heavily fined. The RGA is now arguing that this move is in direct violation of laws set
forth by the European Commission.
As late as November of last year, the RGA published a press release commenting on the proposed regulations, as well as
citing at least five categories of rules that are being broken by the Italian
Government. Directly following this public confrontation, numerous members
of the RGA attempted to find mediation with the Italians, as well as discourage
them from passing the proposal into law.
However, now that the regulations
restricting the business of online casino gambling have indeed become a reality,
the RGA is definitely looking into the various possibilities of legal action.
The case would be substantiated by the law set forth by the European Commission,
which says cross-border trade can be impeded or banned by a country if there are
objected moral grounds. However, services cannot be banned due to
cross-border competition.
